If foreign candidates are being considered to fill a position, academic units must consider the limitations which the immigration law imposes on the hiring of foreign nationals. Refer to the International Student Services Office for specific information and guidance regarding eligibility of any specific foreign candidate for an appropriate immigration classification. Since the immigration law can and frequently does affect the nature of an employment offer which can be made to a foreign candidate, and can even determine whether the candidate is employable at all in the United States, academic units should never extend an offer of employment to a foreign national who is not a permanent resident of the United States without first consulting the International Student Services Office to determine the candidate’s eligibility for employment under the immigration law.
